Terms of Service — Online Education

1. Acceptance of the Terms

These Terms govern access to and use of the Motionforge Edit website, live online lectures, group training, recorded educational materials, course platform, downloadable resources, documentation references, portfolio or workflow discussions, and related support. By purchasing, registering, creating an account, attending a session, accessing materials, or otherwise using the services, the participant agrees to these Terms and the policies incorporated by reference.

A person who does not agree must not purchase or use the services. A person accepting on behalf of a company, studio, school, or other organization represents that the person has authority to bind that organization.

2. Eligibility and Account Responsibility

Participants must be legally capable of entering a contract. A minor may participate only with the authorization and supervision required by applicable law and the consent of a parent or legal guardian. Account information must be accurate, complete, and kept current. Login credentials are personal and may not be shared. The account holder is responsible for activity conducted through the account and must promptly report suspected unauthorized access.

3. Nature of the Services

Motionforge Edit provides online education concerning Motion Capture technology and professional production workflow. Education may include demonstrations of hardware, capture preparation, calibration concepts, software interfaces, tracking and data review, cleanup principles, retargeting, real-time engine workflow, documentation, and related technical resources. The exact topics, duration, prerequisites, instructor, access period, and included resources may vary by program and will be described in the applicable offer or order confirmation.

The services are educational. Motionforge Edit does not manufacture, install, repair, certify, or resell Motion Capture equipment. References to manufacturers, platforms, software, products, distributors, or representatives are informational and do not create an agency, partnership, sponsorship, or guarantee.

4. Programs and Pricing

Unless a different written offer applies, the standard formats are: a focused one-to-one workflow lecture at $150 for one hour; a group workflow lecture starting at $300; and the Motion Capture: Zero to Pro course at $500. Group pricing may vary according to participant count, preparation requirements, duration, requested topics, and delivery schedule. Prices are stated in United States dollars unless the checkout or invoice says otherwise.

Applicable taxes, payment-processing charges, currency-conversion costs, or bank fees may be added or charged by third parties. A purchase is not confirmed until payment is successfully authorized and the participant receives confirmation.

5. Scheduling and Participation

Live sessions are scheduled by mutual agreement and are subject to instructor availability. Participants must join on time using the specified platform, test their equipment and internet connection, and provide requested background information before the session. Late arrival may reduce the available teaching time. Failure to attend is handled under the Payment, Cancellation & Refund Policy.

Participants must behave professionally and must not disrupt sessions, harass others, record without permission, disclose another participant's confidential material, or use the service for unlawful activity. Motionforge Edit may remove a participant from a live session when reasonably necessary to protect the instructor, other participants, systems, or materials.

6. Educational Materials and Third-Party Resources

Course materials may include video, audio, images, diagrams, slides, checklists, templates, project examples, documentation references, links, and downloadable files. Materials are provided for the registered participant's personal or internal educational use only. The Intellectual Property & Acceptable Use Policy applies to all materials.

Official manuals and other third-party materials remain subject to the rights and terms of their respective owners. Motionforge Edit may provide links or directions to those materials but does not control their continued availability, accuracy, compatibility, price, license, or terms.

7. Software, Hardware, and Technical Requirements

The participant is responsible for obtaining compatible devices, software licenses, accounts, internet access, and any equipment needed to follow a demonstration or complete an exercise. Unless expressly included in writing, tuition does not include hardware, third-party software, plugins, subscriptions, cloud services, shipping, installation, or technical support from a manufacturer.

Software interfaces, product specifications, documentation, and platform behavior may change. Motionforge Edit may update demonstrations, substitute compatible examples, or revise resource references when a product changes or becomes unavailable.

8. No Recording Unless Authorized

A participant may not record, livestream, photograph, transcribe, capture, or redistribute a live session without prior written authorization. Motionforge Edit may record a session for quality, security, or educational purposes only after providing any notice or obtaining any consent required by law. Any authorized recording remains subject to the intellectual-property and confidentiality provisions.

9. Participant Materials and Confidentiality

A participant may voluntarily submit project files, screenshots, workflow descriptions, or other material for instructional discussion. The participant represents that the participant has the right to provide the material and that its use for the requested educational purpose will not violate confidentiality, privacy, employment, client, or intellectual-property obligations. Participants should remove sensitive information and obtain required client or employer approval before submission.

Motionforge Edit will use submitted material for the requested service and reasonable internal administration. We do not undertake a general duty to preserve trade secrets unless a separate written confidentiality agreement is signed.

10. Payment, Cancellation, Refunds, and Delivery

Payment, cancellation, refunds, rescheduling, course access, and digital delivery are governed by the Payment, Cancellation & Refund Policy and the Course Access & Digital Delivery Policy. Those policies form part of these Terms. Statutory rights that cannot lawfully be waived remain unaffected.

11. Disclaimer of Outcomes

Education is provided to improve understanding and practice. Motionforge Edit does not guarantee certification, employment, promotion, income, equipment performance, uninterrupted software operation, admission to a program, completion of a project, or any particular creative or commercial result. Progress depends on the participant's prior experience, equipment, software, practice, time, technical environment, and decisions.

12. Suspension and Termination

Access may be suspended or terminated for nonpayment, chargeback abuse, credential sharing, unauthorized recording, infringement, redistribution, security threats, harassment, unlawful conduct, material breach, or conduct that creates technical or legal risk. Where reasonable, the participant may receive notice and an opportunity to cure. Serious misuse may result in immediate termination without refund to the extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, Motionforge Edit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, opportunity, data, production time, or goodwill; equipment damage caused by participant handling; third-party platform outages; or decisions made based on educational content. To the maximum extent permitted by law, total liability arising from a specific paid service will not exceed the amount paid for that service during the twelve months before the event giving rise to the claim.

These limitations do not exclude liability that cannot lawfully be limited, including rights that apply under mandatory consumer-protection law.

14. Indemnification

To the extent permitted by law, a participant using the services for business or professional purposes agrees to defend and indemnify Motionforge Edit from third-party claims arising from the participant's submitted materials, unlawful use, infringement, unauthorized distribution, violation of another person's privacy or confidentiality, or material breach of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law principles. Before filing a formal claim, the parties will attempt in good faith to resolve the issue through written notice and a reasonable opportunity to respond. Unless mandatory law provides otherwise, exclusive jurisdiction and venue will lie in the state or federal courts serving El Paso County, Colorado.

16. General Provisions

If a provision is held unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. The participant may not transfer access or rights without written permission. Motionforge Edit may assign these Terms in connection with a reorganization, financing, sale, or transfer of the business. These Terms and incorporated policies constitute the agreement concerning the services unless a separate signed agreement expressly controls.
